Streator woman killed in accident with semi

Comments Off

On Tuesday, an accident on Route 18 just outside of Streator claimed the life of passengers in one of the vehicles involved. It occurred when a semi jacknifed, with the trailer entering into the lanes for oncoming traffic.

The collision resulted in fatal injuries to the one passengers and injureis to four other occupants of the vehicle that required hospitalization.

The semi driver was ticketed for driving too fast for conditions.

The issue of who was ticketed is one that comes up frequently in cases involving car accidents. While the issuance of a ticket to the responsible driver may help to get his insurer to accept liability for the accident, the law in Illinois is that evidence of a traffic ticket is inadmissible unless the ticketed driver pleads guilty. Even if the responsible driver is convicted at traffic court, the fact that he received a ticket is inadmissible as evidence if he pleads not guilty.

One thing that is important in protecting your rights in a case following a car accident is to go to traffic court when the responsible driver receives a ticket. Many tickets issued to the responsible driver are simply dismissed when the victim fails to show for traffic court. Showing up in traffic court greatly increases the odds of a guilty plea which can only help you in a later personal injury case.
